Wrongful Termination

Postby Arnolde » Tue Dec 06, 2016 10:51 pm

Hi-   Basically I was fired because I was covering a shift for someone and I had the wrong time to be in. So i was 45 minutes late, but 15 minutes early to the time I thought i was suppose to be in. He had a manager call me while in route to tell me not to bother coming in. However, the restaurant I worked for has this system where you get written up for being late, missing a shift, etc., and if you get 3 write ups you get fired. I had only 1 write up(for eating without asking) when I was fired, so this would have been my second. I was first suspended for two weeks and told to call back at the end of the two weeks, then told by another manager not to bother calling back because the owner(who suspended me) told him, to tell me, i was fired. This owner didn't care for me for no reason, he has his favorites- we'll say. however what bothered him was my sales showed i was the hardest working waitress on most nights.   My question is whether or not i was treated fairly considering, other employees have not showed up at times, where late at times, etc., and were not fired only written up at most. Did he have a right to fire me regardless of the system that he himself set up to ensure fairness?

You can be fired for being late and for not following company policy. In right to work states or commonly called "At Will" states you can be fired with no reason.

You will be able to draw your unemployment if you can prove to the Department of Labor than you were not treated fairly. If you cannot prove this than you will be denyed unemployment.
