Workers Comp//heart Attack

Postby Glaedwine » Sat Dec 03, 2016 6:51 pm

I suffered a heart attack while on the job in July.  Had quad bypass surgery and still have 2 other surgeries scheduled one of which is a hip replacement.(still out of work) My employer refused to put the claim in with workers comp and told me to put a LTD claim in with insurance company. I did and now they are nit honoring the claim. so I demanded that my employer put in with workers comp co. They did reluctantly and now informed me that because of business necessities they find it necessary to replace my position and therefore I have no job and have to pay COBRA.  Can they fire me like this?  Just after they had to put a workers comp claim in? I live in suburb of Chicago.

Sorry to hear about your heart attack and following problems. But to start this unless your heart attack is related to your job or was caused by the job it would most likely not be covered by Workers compensation. But I live in Utah and have gone through this process here and each state has there own rules. I looked up some information for you and have included the following links for you use.http://www.state.il.us/agency/IIC/

The site above is the state web site for workers compensation commisition and will most likely give you a little help but not much.http://www.chicagoworkcomp.com/work-injuries.htm

This is an attorneys site and where I would start. I always advise on using attorneys because they can get the process moving and know how the law in there state works. So I hope this gives you some help and you get on the road to recovery soon. Wishing the best
