I WORK FOR THE SCHOOL HE IN TN I WAS TOLD THAT FROM NOW I MUST TAKE ALL BREAKS IN BREAK ROOM TO BE NO WERE ELSE BUT THERE THIS IS NOT A SCHOOL THING THIS A BOOS THING IS THIS RIGHT ALSO I WORK BUT DID NOT CLOCK IN BUT DID CLOCK OUT WHEN I CLOCK IN THE NEXT DAY TIME CARD WAS GONE WHEN I CAME BACK THE NEXT DAY NEW TIME CARD WAS THERE WITH BOSS SIGN ME IN IS THIS RIGHT THXS

Chris,

While I am a bit unclear as to your questions/issues, I believe the following address the break and time card issues.

An employer can generally require its employees to stay on the premises during their rest periods - so long as the employees are completely relieved of all duties during the break time.

The Department of Labor wage and hour regulations allow employers to deduct lunch breaks or rest breaks if the breaks are at least 20 minutes long - shorter breaks must be paid.

The Fair Labor Standards Act(FLSA)requires an employer to pay employees for all hours actually worked - even if you did not properly punch in/out on the time clock.  If you boss corrected your time card to accurately reflect the actual hours your worked, this would be legal.  If he is incorrectly recording your time, or deducting time due to your forgetting to clock in, this would be improper and you would be owed for any hours you were shorted(and overtime pay if those hours cause you to go over 40 hours per week - or 8 hours per day in states such as California).  While your employer can discipline you(write you up, etc) for failing to properly clock in/out - they may not use this as a reason to not pay you for time that you actually worked.
