Teacher Slanders Student

Postby Kuen » Tue Dec 06, 2016 5:58 pm

A Georgia HS teacher recently accused a student in that HS of initiating an online group that fosters racism and treason - calling the student(by name) a racist and accusing him of treason.  She spoke these words in at least one and likely several classes and reported the student's "racist and treasonous" actions to the HS administration.  She told her own students that if any of them were members of this group that she would refuse to help them in any way. A review of the online posts by the administration clearly indicates the charges are false.  There has been no retraction nor apology.  Is this teacher potentially guilty of slander?

Teacher Slanders Student

Dear Jeff,

I'm not an attorney and don't know the laws on slander or libel well enough to know whether they might apply in this case. Given the facts as you state them, it certainly seems to me that the teacher's actions were unacceptable, that the school system administration should have this brought to their attention, and that apologies(or possibly more, including perhaps disciplinary action against the teacher) are in order.

If the facts are indeed exactly as you have laid them out here, and there are no important relevant additional facts, I'd think a consultation with an attorney or possibly with the Georgia ACLU would be worth considering. A carefully worded letter(and an attorney might well help with this, also) to the school, making clear the possibility of legal action or media attention, *might* also be advisable.

Good luck and regards,

Ed Buckner
