Slip And Fall

Hi, so my fourteen year old daughter was on her razor scooter going slowly when she hit a bad crack in the city side walk which was in the process of being fixed but did not have any men at work signs around the area. She broke her leg/ankle in half, both bones fib and tib and her ankle was dislocated. The first hospital I went to ruined her bones even more when they tried to pop in the ankle knowing that there were three broken bones around it. She was transferred to another hospital where there were specialists and needed an operation, swelling was so bad they could not operate for four days. She spent two weeks in the hospital missing her final exams, and has rods, screws and metal plates in her ankle for the rest of her life. She was also a former dancer and wanted to go back to dance school. She is now suffering depression as a result of her injury. Woulsd we have a case if i sued the city and hospital for malpractie? Please let me know if I have a case?

I cannot give an opinion on the medical malpractice case. Would need to hear what a ortho surgeon has to say about her case. In regards to case against the City, there may be a case depending on what the condition of the sidewalk was. How big a defect? Was it really in the process of repair but no barriers or signs? How visible was it? Need more details on condition of the crack. If the defect was "trivial", probably no case. City not required to have perfectly smooth sidewalk surface. Cracks are to be expected. Anyhow, the injuries are surely serious enough to interest a personal injury lawyer in looking at it. Get some photos of sidewalk if not too late. If it is already repaired and you can't show condition that caused the accident, then the case might not go anywhere. Did the City do a report on the accident? Have you seen what that says? Again, the injuries are such that a personal injury lawyer would probably be willing to investigate. Contact a local personal injury lawyer. It will not cost anything.
