Slip And Fall In Restaurant Restroom

Monday night I went out to dinner with friends. We got to the restaurant, placed our orders and while the busboy was pouring our waters I went to the(individual) unisex restrooms. I closed the door and slid on some water and my ankle twisted all the way around and I heard a large crack. Down I went hitting the sink and then the toilet with my head. I blacked out. When I came to I couldn't move and I was yelling in pain. The owner and the police had forced the door open and were yelling at me to get out of the restaurant because I was bothering the other customers. Police said I would be arrested if I didn't get up. I told them I couldn't and my friend got paramedics to come in, evaluate and take me by stretcher to the hospital. My leg was spinted twice, MRIs done, Cat Scans, I had a neck brace put on and xrays showed my all of the bones in my ankle had shattered. I needed Emergency Surgery. Tuesday I got a bed, Wednesday a 4 1/2 hour surgery was performed, Thursday my surgeon and my insurance sent me to a rehab/convalescent home where I am to remain  for the next two months with intensive therapy and on both percocet and oxycodone. All doctors say this is serious and will affect me for life, and that I should sue. So I am writing this from the rehab. Today is Saturday - still all new. What do I do next? I want to do everything right as I am damaged and in extreme pain. Can you please give me your advice/instructions on what to do now? Thanks! Richmond Chandler

Mr. Chandler,

It certainly sounds as if you suffered a terrible ordeal. You are doing the right thing in getting the medical treatment that you need and deserve. It sounds as if you have the basis for a lawsuit against the owner and/or managers of the restaurant both for the negligence in causing you to fall and for failing to offer assistance. However, you will only know if you have a possible lawsuit if you contact a personal injury attorney and the attorney investigates and assesses your case.

I do not know where you reside or where the restaurant is located. I would recommend that you contact a personal injury attorney in your area. If you do not know one, you can contact the local bar association and they can find you one. The personal injury attorney will meet with you and take the following steps:

a. Take down your story and collect whatever evidence you have.

b. Collect any records from the incident, including the police report, EMT or ambulance report and the medical records. c. Interview witnesses you can identify.

d. Provide an assessment of your case.

e. Take the legal actions available to you, including filing a lawsuit to seek damages.

You should not pay a fee for the consultation with the personal injury attorney. The consultation should be free and if you retain an attorney to represent you ,the attorney should do so on a contingency basis(meaning you pay no money upfront, only if you receive a settlement or jury award). You can help your case by doing the following:

- Follow the medical advice given you by your doctors.

- Collecting any and all evidence related to the night in questions. Everything from damaged clothing to receipts to pictures.

- Write down the names and contact information of any witnesses.
