HI CAROL! WELL, ON DECEMBER 14,2010 AT 6:30 I FELL DOWN THE STAIRS OF MY RENTED APARTMENT. THE STAIRS ARE INSIDE THE BUILDING SO THEREFORE, THERE IS A LIGHT BULB THAT IS SUPPOSE TO COME ON AUTOMATICALLY WHEN ITS DARK OUTSIDE. WELL, HERE IN MIAMI IT'S ALREADY DARK BY 6PM. THE LIGHT DOES NOT COME ON UNTIL 7:00PM. I WALKED OUT OF MY APARTMENT, SINCE IT WAS VERY DARK, I WENT TO STEP DOWN A STEP, MISSED A STEP AND FELL DOWN THE STAIRS. I CALLED THE AMBULANCE AND WHEN THEY GOT HERE, THEY ASKED MY HUSBAND TO PLEASE CUT ON THE LIGHT TO CHECK MY INJURY AND MY HUSBAND TOLD THEM, THAT THERE WAS NO LIGHT. THAT WAS WHY I FELL. I GET TO THE HOSPITAL, THEY DO SOME X-RAYS, AND COME TO FIND OUT THAT I HAD 2 BONES AND A LIGAMENT BROKEN. ON JANUARY 3,2011, I HAD SURGERY. THEY HAD TO PUT A MEDAL PLATE IN MY ANKLE AND 7 SCREWS TO HOLD MY BONES IN PLACE. THE DOCTORS TOLD ME THAT I WOULD NEED THERAPY TO LEARN HOW TO BE ABLE TO WALK AGAIN. THE DAY THAT I FELL, I HIRED AND ATTORNEY TO TAKE CARE OF MY CASE. HE SEND AN INVESTIGATOR RIGHT AWAY THAT NEXT DAY I FELL RIGHT AWAY. HE TOOK PICTURES OF A LOOSE RAILING, A CRACK ON THE STAIRS WHERE I FELL AND AT THE LIGHT BULB THAT WAS OFF THE DAY THAT HE CAME TO TAKE THE PICTURES. TOOK IT BACK TO THE ATTORNEY AND SO... TODAY ID 02/14/2011 AND HERE I AM, ON MY BED, WITH MY FOOT ELEVATED WITH A CAST ON IT UNTIL THE DOCTOR SEES ME AGAIN ON THE 17TH OF FEB. MY QUESTION IS, AFTER I NO LONGER HAVE TO GO TO SEE THE DOCTOR FOR THE THERAPIES OF MY ANKLE, THE ATTORNEY GETS ALL MY MEDICAL BILLS AND SEND THEM OR PRESENT THEM TO THE OWNERS PROPERTY INSURANCE COMPANY, WHAT WILL BE NEXT? WHAT IS THEY'RE JOB? AND ALSO, WHATS THE MOST, IN YOUR EXPERIENCE, WILL I BE ENTITLED TOO IF THEY WANT TO SETTLE OUT OF COURT? OR EVEN IN COURT? THE DOCTOR SAID THAT THIS MEDAL PLATE AND SCREWS IN MY ANKLE, IS PERMANENT. PLEASE ANSWER ME. I AM NEW TO THIS AND I DONT WANT TO SETTLE FOR TOO LITTLE OR TOO MUCH!!! THANK YOU AND GOD BLESS YOU!!1

I am sorry to hear about your fall and injury. You have suffered much since you had so much damage and required surgery. I hope you are able to follow through on your physical therapy and have the best recovery possible.

I practice law in New York and am not well-versed in the laws of Florida nor the practices in the Miami area. You have taken the right step in retaining a local attorney and from what you say, it sounds as if that attorney is doing well for you by acting so quickly to investigate your case. The questions that you ask me you should ask of your attorney. Your attorney should take the time to answer your questions and help educate you about the legal process and your rights and responsibilities. Your lawyer should explain who will pay for your medical bills and what is a fair value of your case. On the question of paying for your medical bills: It is likely that part of the claim you made against the landlord is for medical expenses. You should ask your attorney about this issue. Under most arrangements, the defendant will not pay for medical expenses until you settle the case or win a verdict in court. If you have private health insurance, Medicaid or Medicare, that insurance should pay your bills, though the insurer may want reimbursement if you collect a settlement or award that pays for medical expenses. If you lack health insurance, then you will have to pay for your medical care upfront. It is possible you can work out a lien arrangement with your provider. Under such an arrangement, a provider will file a lien in lieu of receiving payment now. The lien will state that the provider will be paid out of any future court award or settlement that you receive. Your attorney should be able to help you work out lien arrangements. As for the amount of a fair settlement, that varies depending on the nature of the injury, the laws of the state and the pattern of local court awards. I do not have enough information to tell you what your case is worth. In the cases I handle for my clients, I prepare a detailed case assessment that estimates what a case is worth at trial and the equivalent settlement amount. Your attorney should be able to tell you the value of our case so that when or if you receive a settlement offer from the defendant, you are able to assess that offer.
