Releaving Letter Issue

Postby Darrik » Fri Nov 25, 2016 11:09 am

Hi SIr,

Need your urgent help.

My previous company notice period is given below:

"Your services are terminable with two month's notice on either side. The Company may at  its discretion, choose to terminate your services with two month's Basic salaryin lieu of notice period"

I got a good opportunity and i resigned with immediate effect and ready to pay two months salary. now company says we'll not accept it "Policy has been changes there is no buyout option you have to serve 2 months notice period", i tried everything but they didn't listen to me.

New company accepted me without re-leaving letter, i showed only salary slip,

Now i m looking for a job change, every company asks for re-leaving letter of previous company, is there any way to get re-leaving letter or exp letter now.

Kindly help

Releaving Letter Issue

It seems you have left the company by serving the notice as per the termination clause contained in your terms of engagement. However, if it was also mentioned in it that you shall be governed by the service conditions in force at present as well as to be modified from time to time, then the company's stand will be correct. The said modifications, made if any , would be valid provided an office circular was issued about the said modification and otherwise not.Since you have already joined a new organisation and they have not insisted for any release order from your previous employer, you have nothing to worry about. If you make any further change, the new employer will insist only a release order/pay slip from your last employment only.So for that also ,you need not worry. In case , your previous organisation does not release your outstanding dues, you shall have to file a recovery suit against them.Lastly, please concentrate on your existing job, work there peacefully and remain mentally happy.
