Regardnig Private Property Accident

Postby Avisha » Tue Nov 29, 2016 11:14 pm

Ok, I have 2 vehicles. my newest one is insured in my name. My second vehicle is never used and is a 92 blazer. so it's no insured. My fiance decided to take it out to the bank up the street secretivly knowing I'd get pissed if it was driven with no insurance.  ... In the bank parking lot she stopped when a child ran in front of her. The car behind her rear ended her. Did no damage to the Blazer but damaged the hood of the other drivers car. Police showed up, Did not issue a ticket and said that since it occured on private property they do not issue a report on who is at fault...

I am curious to know since this is in my name Obviouly my insurance only covers my car so it will not pay to fix this lady's vehicle. Since she is at fault or no report was filed by a ciop of fault since it happened on private property are we responsable for paying off her damage? or am I going to get the bad end of the stick for my fiance's lapse in judgement since the SUV is fully in my name?

Hi Rick, since the vehicle is registered in your name you are on the hook but so is your fiance because she was driving it withour your kowledge or permission.  You can both be sued by the other driver.  If he does the right thing though he should report this event as an "unavoidable accident" given the circumstances of the child running in front of your vehicle and thus go under his own collision insurance.  In short, if it comes to a claim against you the claim must also include your fiance as a named defendant.
