In a malpractice case involving prescbers giving too much meds resulting in the patients death, does the pharmacy whofilled the meds libile in any way because they could have refused to fill the meds that they thought was a dangerous combination and advised the pt. to talk to the doctors about the mediaction regimen given

One duty that pharmacists have is to warn patients and doctors when a prescription may cause harm. Pharmacists who know that a combination of medicines is dangerous must call the doctor and discuss it with him. Often, however, the doctor wins the argument. If you do sue a pharmscist you are going to have to show that he did not offer any opposition to the doctor and did not exercise his duty to notify the doctor or patient of a danngerous situation.

Talk to some malpractice lawyers and see if one will help you.
