Payroll Error-laws On Corrections

Postby gwydyon64 » Sat Nov 26, 2016 7:01 pm

Is there a law or guideline on correcting payroll errors?  For instance--5 hours of OT wasn't paid on one payroll check, so the employee brings it to payrolls attention(along with the supervisor noting the error to payroll), then not only is that not corrected on the following pay period, the company also shorted the employee anoter 20+ hrs of OT.  When or what is an acceptable timeframe to fix the error?

Also, the company sent letters to employers stating a raise would be RETROACTIVE and payment would be made for the past time that the raise should have been in effect.  However, that was over a month ago and no retro pay has been seen yet, is there a law on WHEN this should be paid?

ANSWER: Errors should be paid the next payday after they are discovered. Raises are up to the employer thay are not regulated by government regulations.

The previous payroll errors were not fixed, and now there are 20+ more hours not paid.  Thanks for the response.  Where can I find the specific law stating when it should be paid?  (For the state of TN.)

Tennessee Wage Regulation Act Title 50–2–103 requires employers of private employments of 5 or more employees to establish and maintain regular pay periods at least twice monthly. Penalties may be accessed for violation of this section against those employers for missing a regularly scheduled payroll date and in paying their employees late.

Anyone who has a problem collecting wages can file a wage claim with the Tennessee Department of Labor and Workforce Development's Division of Labor Standards. If the circumstances are such that we are unable to help, the complainant is referred to court. http://www.tn.gov/labor-wfd/faq_laws.html#wageregulation
