I am starting a new job in California where I have just moved. I read your previous answer to someone about earned vacation, thank you. Does this apply to commissioned employees also? I am base +commission. Also, my new employer told me that it is agains Cali labor laws to give me more vacation than the other sales people, is this true?

He also told me that Cali labor law states that I will not get a paid vacation unless I meet quota. True? Thank you very much.

I do not deal with commissioned only employees, but since you are also earning a base pay you should be treated the same as any other employee. The employer is not required by law to furnish vacation or pay out vacation pay. If he does furnish it he must go by his policy with every employee. One employee cannot be treated differently than another employee. Whatever his policy is on vacation this is how it must be. I do not believe it is true that you have to meet any type of Quota to be paid vacation.
