s About Taxes)/LLC for Realtors Advertisement Expert: Richard Fritzler - 12/18/2008 I am a real estate agent who formed an LLC in 9/08.  I was paid commissions as a self-employed person through 8/08 and then all 4th quarter commissions were paid to my LLC, of which I am the sole member.  I have not made any tax payments for either entity for the year.  I am going to file a quarterly payment for myself by 12/31/08 on IRS form 1040-ES.  How do I file the quarterly payment for the LLC...is it form 941-V?  And should I pay myself a salary for the 4th quarter out of the LLC?  Your help is much appreciated...

I have spoken to many Realtors, Prudential Realty actually had us speak to their key agents in each of their offices; Some of which were pressing for changing their personal business structure. they asked us to come in and eliminate the confusion and offer a sound option. Many Realtors had heard . . . or researched . . . or were confused by . . . the LLC, S-corp, real corp, structuring to reduce their taxes. While many had been given some information, it was generally incomplete, and would lead to higher taxes overall. We spent the time, to explain all the nuances and help the develop a solution that actually would provide a benefit.

To get past all the confusion; the LLC has made no change in your tax situation. Since it is a single member LLC the IRS requires it be treated as your sole proprietorship was prior to its existence. You are imagining that somehow the LLC is a separate entity. But that would be a fiction. all you have accomplished is to make things a little more confusing.

You are going through all those cycles of action for no net gain. Sorry.

If you are looking for a tax benefit for your real estate business, you are going down the wrong road. Instead of you guessing the right way, and then asking me specific questions, only to find out it is not as you had thought, just call me, and we'll discuss the options that make the most sense for you in your situation.
