Indemnity Bond To The Government Of India

Indemnity Bond

Dear Javed

I have signed an Indemnity Bond to the President of India on 12/06/09 for my friend, so that she could apply for her extension of visa. I quote: "And in consideration thereof, Mr. Mohiuddin hereby jointly and severally agree to provide or cause to be provided to the Govt. of India, suitable maintenance for the said....and in the event of Mr. Mohiuddin failing to provide or cause to be provided such a maintenance, Mr. Mohiuddin hereby jointly and severally agree to pay to the Govt. of India, the costs and expenses of maintenance of the said.......as long as she shall be resident in India"

I am attaching a scan of the document.

In the meantime our relationship has soured. I have reason to believe that she could use this document to obtain maintenance from me.

Is this possible?

1. could she approach the Government of India for maintenance and they would claim it from me?

2. could she approach me directly for maintenance? And if yes, up to which amount(she as a foreigner has a quite high standard of living)?

3. could she approach the court directly for maintenance with this document, and if yes, the court in Pune(her residence) or in Goa(my residence mentioned in the Bond), or the court in Srinagar(I will be returning to Kashmir in a few days)?

We were in a live in relationship for 1 year - can she also claim alimony from me on this ground?

Hello Mohiuddin,

The indemnity is given to the Government of India in the name of the President of India and in my opinion does not directly allow the sponsored to claim under the bond from you. She should satisfy to the Government of India that she is unable to maintain herself and the Government should support her stay and upon such petition to the Government, the indemnity is invoked against you.

As for maintenance and alimony from courts, in my opinion, she is not entitled to it. The best answer can be provided by an immigration lawyer as this is purely an issue pertaining to immigration and ministry of foreign affairs. Consult a good lawyer on immigration who will be best able to guide and advise you in this matter
