H1b Visa Approved After L1b Blanket Denied?

Postby Bryten » Mon Sep 19, 2016 11:32 am

Sir,  I came to India on 1st feb 2011 and attended went for visa extension stamping on feb 22, 2011. I was issued blue slip and after 3 months, I got visa refusal letter from consulate stating that "I have no specialised knowledge to work in this project". My company has accepted to process h1b visa now. my question is will my previous visa refusal in any case affect my new visa petition or should I wait for a year and go for h1b process. kindly give me your views regarding my case

H1b Visa Approved After L1b Blanket Denied?

L1B is independent of H1B. Therefore, as long as your information stated on the H1B petition does not directly contradict your degrees and experience stated earlier on L1B petition filed with the USCIS, the Consulate should issue you H1B visa stamp. There is no advantage in waiting before your company files H1B petition for you, especially since H1B is subject to the visa cap.
