Getting Transcripts From Private School

My daughter attended a private school for 9 years. She is now going into the 11th grade and due to the economic situation in my household, I can no longer afford the private school.  I have found a great public school for her to attend, however, the private school she was attending will not release her transcripts because I owe a balance from last year.  I told them I will make payments on it but they refuse to release her records. Is this legal on their part?  My daughter cannot start school without these records.

It is my understanding that as her parent I have legal rights to her transcripts.  I live in the state of Florida.  I have tried to negotiate a payment plan with the Private school but they refuse.  I do not see how they can deny my daughter of going to school because of this since it is illegal to keep a child from going to school in the first place. Please advise. Thank you so much.  Also, I was thinking if I HAD to file bankruptcy for this, the unpaid tuition would be part of my debt and they would have to release the transcripts but I do not want to go to that extreme if I dont have to.  I have been researching online the Florida statutes about education but can't find anything....Im sure I just don't know where to look.

Hello Melissa,

I am not a lawyer.  Let me get that out first.

That said, you should be talking to one.  If not one you hire, then one who works for the State of Florida.  This is the link for the Attorney general's Office http://myfloridalegal.com/  They will be able to tell you your legal rights under Florida Law.  There might also be help through legal aid if you have no money.  Try http://www.floridalegal.org/

I have wondered in the past if a private school, a business, can keep grades for financial reasons, just as a parts supplier could withhold parts to the builder of a product if they are owed money.  It is a contract for a service...again, I am not a lawyer.  Florida has a site that talks about private schools as a choice, and things to keep in mind, including money and what happens if you don't pay:

Financial Policies and Practices

Private schools all have specific policies and practices governing financial matters. Parents are encouraged to ask the following questions: -What is the history and financial stability of the school? -What are the policies and practices concerning payment of tuition? -Is tuition refunded if the student leaves during the school year? -What penalties or consequences are there for unpaid tuitions or fees? -Are all expectations regarding tuitions and fees published and part of a contract that parents sign? Two thoughts:

-Have you asked the public school to call the private school?  It is possible there is a level of information they could get that would at least get you in the right grade.

-Do you have her report cards?  Those could serve as an official record.  You might even be able to ask for back copies of report cards from the private school.

Regarding bankruptcy: My understanding of debt resolved through that process is that it remains unresolved until the proceedings are over.  That might take a long time.
