Extradition From Miami,florida To Atlanta

Postby Treffen » Wed Nov 02, 2016 11:32 pm

I have a very old warrant from 1995 in atlanta georgia the charges were possesion with intent to distribute 7 grams of marijuana and escape being a stupid 18 yr old I jumped the $10000 bail. This charge has haunted me my entire adult life but never came up when my name was ran until about 9 years ago. Then it started to come up but I have not been held on it, I had my name run through ncic as close as new york. I want to clear this up but have no money for bail or lawyer. Georgia does not seem to want me but now I am in florida and hope to get a job and finally save enough money to straighten this out. I am applying for a permit to drive a cab and this requires finger printing and criminal background check. The application asks about felony convictions(I have none) not warrants, is there any way for me to know if I will be arrested on the spot since I'm now in a neighboring state?

Ray-

It's been our experience that states rarely keep small marijuana cases laying around for 2-3 years let alone 16-years. There is a better than good chance they have desposed of the marijuana by now and/or the arresting officer is long retired or forgot any of the details about the case. However, the Failure-to-Appear(it's bond jumping...not escape) probably is still on the books. Keep one thing in mind, you jumped bail once so, if you are arrested on this charge, the odds of you getting out on bail again is most probably nil - especially, since you don't even live in Atlanta anymore.

NCIC is a nationwide computer system so it doesn't matter what state you are in. If you are listed as a fugitive, you will be 'hooked' no matter what state you are in. However, in this case, because it's so minor in nature, they(Atlanta PD) may have cleared it off their books and removed it from NCIC for "lack of prosecution." You don't want to call an airstrike in on yourself so go to 7-11 and buy a telephone card. Go to a payphone and call the warrant section at the Atlanta PD and inquire about the warrant. You can also call the local District Attorney's Office there in Atlanta but the PD would be the best bet. They are the ones who would hold the warrant. If you have the funds, you could retain an attorney in Atlanta to make the calls for you and, if necessary, file a Motion to Dismiss on your behalf.

You should get some closure on this so it's not hanging over your head.
