Does Legal Aide Base Help On Your Total Income If You're Not Married?

My friend is in dire need of a lawyer...to make a long story short, 2 weeks ago, her ex let her have their 4 year old son for 2 weeks. He got to spend time with his three older brothers, mom and her fiance. Poor little guy had a bad week--he stepped on a nail(called an ER nurse about it & told her that since he was 4, he should be fine if all immunizations were up to date), got hit in the neck with a stick by his brother, and fell off a scooter and scratched his bum. When she took the baby home at the end of her two weeks, she explained to her ex all that had happened & he said that the last tetnus shot was at 14 months. now the ex is claiming that it's "child abuse." She wants to take him to court and modify the custody and mediation agreements. However, the deep pockets of her ex's father can get him a lawyer, while she has 3 growing boys to raise & limited income. Does legal aide base on HER income only since she's not married? Where can we find a pro-bono lawyer?
