Do I have a case for Medical Malpractice?

Postby bing49 » Wed Aug 15, 2001 7:06 pm

I was pregnant with twins at 31 weeks and had questions about the swelling I had (because when I would sit on my ankle, it was like a memory foam mattress denting when I took it off), the doctor shrugged it off as normal. Then later in the same visit, he said all my tests came back normal except for my blood test showed I had low hemoglobin counts and he didn't tell me anything more about what that meant and sent me home. 10 Days later, I had a headache where my vision went weird (I could only see 1/2 of things) and my husband had an appointment to see the doc, so I told my hubby to ask the doc if that was normal to have that sort of vision with a headache. He told him Yes and that I should lie down for a while until it passed. Later that day, I fainted and had several seizures (eclampsia) and ended up life-flighted in a coma with an emergency c-section, and in heart failure. Should I sue the doctor for negligence? Do I have a case?

Find an attorney who specializes in medical malpractice cases involving pregnancy. Have your records evaluated. Only then can you get an idea if there was negligence on the doctor's part.

The evaluation should cost you nothing.

Thank you Yak Rider for a great answer and not just throwing out an opinion. I noticed alot of doctors tend to stick together here. What people didn't realize is that I was already a "High Risk" Pregnancy because I was having twins and given that, the doc should have taken my symptoms seriously

You fail to show where the doctor was negligent. In order for you to sue for medical malpractice you must show negligence and I don't see that here. You'd have to prove those tests would have told him something or that the swelling was abnormal, a sign this was going to happen and did nothing about it. I don't think you will be able to connect all of this together and have a successful case.

You'd only have a case if at the visit when he reported all your tests were normal (except for the mild anemia) he lied, and your blood pressure was elevated, and your urine full of protein. From what you've put in your post, there's nothing except that he couldn't predict the future.
