I am German and been married to a american soldier 26 year,last year I filed for a divorce in Indiana,because JAG office told me I have to file in his Home of record,because if I get a divorce here in germany they cant do the retiermend divison,last week they dismissed the case here in Germany,but they dismissed the case in Indiana also,because now my Husband is a recident of alabama,but by the Time I filed(July 2010) he was at a deployed,so my questionis is: if I am getting divorced in Germany will I loose all my Benefits? the FORMER SPOUSE PROTECTION said after 25 years I will get 50% of his retierment pay.will I lose everthing than

Dear Birgit,

The German court can write in the divorce degree: "Der schuldrechtliche Versorgungsausgleich in den USA ist vorbehalten(weiterin durchfuehrbar)." That means you can still file for half of the military pension in the US after you got divorced in Germany.
