Distribution Rights

Recently i returned from a working holiday in the U.S. where i discovered a sanitary product that has the potential to be imported and distributed widely in Australia. Can i create and patent the product in Australia or do i need the distribution rights and import directly? What steps would you take to initiate this affair? Many thanks

As the product is already produced in the US, or somewhere, you need to contact the company who owns or markets the product and see if you can make a deal for the sales and distribution rights in Australia.  Creating a patent for the product would probably violate international recognition of patents or trade marks already registered in the US.

By getting a contract for the sales and marketing in AUS you could get exclusive rights for all or a portion of AUS and that should be enough to get you started.  

All of that of course is subject to the company already selling in AUS or planning to do so.  In that case work with them to make a deal to get them there sooner or grow them there faster.  

In either case you and the company get wins by moving the product into the market or growing the market in AUS.
