Car Vandalized While In Driveway Of Friends Home

my daughters car was vandalized while visiting a friend- all four tires were slashed and words "keyed" into her paint- the owners of the home refuse to discuss or provide repair costs to her car  they state they are not liable for her damages and costs to repair/replace such   she only carries the minimum auto insurance which will not repair/replace the tires or cost of removing the words keyed into her paint    would this be covered under the friends home owners insurance?  (state of florida)

Hi LInda,

Sorry to hear about the damage to your daughter's car.

The owners of the home where the car was parked would only be responsible if they were negligent in some way, and their negligence caused the car to be damaged. That is the key to someone else being responsible for something.  Did they act irresponsible and that directly caused someone to key the car and slash the tires?  Probably not.

A couple examples of their negligence would be if they 1) guaranteed the safety of the car while it was parked there. 2) Informed you they had a gate, and would lock the gate behind the car, but they forgot to do so after specifically telling you they would.

I know this is not the news you want to hear...
