Can Hospital Collect On Bills Over 7 Years Old

I have a judgement against me for unpaid medical bills. A few months ago, I was suppose to receive a refund from the Dept of Taxation for taxes I had overpaid, instead the monies went to the hospital. On a recent copy of my credit report it shows the same balance for the judgement. Further investigation revealed the monies had not been applied towards the judgement but to offset other overdue hospital bills. Also, I was told by the DOT rep, that the same hospital had sent other claims for DOT to collect on. The hospital did not disclose the age of the accounts, however some of the bills are 7-12 years old. Was the money suppose to be applied to the judgement first before any other bills? Can the hospital still report bills over 7 years old to any agency in order to receive payments?

Hello Jayla,

Thank you for taking the time to write to me about the hospital bill that you state is in active collection status against you.

There is a huge debate right now in the Debt Collection Industry and in Congress about the ethics and methods that are being used by bill collectors to collect on medical bills.  Things in this arena are changing, and changing quick.

Now, you state that you have a judgment issued against you.  That is a different situation.  The problem is that once the judgment is ordered by the court, there becomes an imaginary line in the sand between the original debt and the REASONING for the debt and the beginning of a NEW DEBT, the debt of the judgment ordered by the court.

So, once a creditor has a judgment against you, regardless of the reason, they can collect for a certain period(usually 10 years) and they can even renew the judgment after the original expiration.

Now, remember this is a NEW DEBT, so the judgment has nothing to do with the Statute of Limitations.
