Backing Out Of A Parking Lot Space Is Not A Fault While Hitting Oncoming Traffic.

Dear Denise, I have been told by my father, a 30  year insurance technologist, reported to me that it is NOT the fault of a vehicle backing out of a parking spot onto a lane of traffic, but rather the lane of traffic, due to that fact that the backing up vehicle cannot see any on coming traffic and yet the oncoming traffic can clearly see the(reverse lights should indicate that one is backing out) backing out vehicle and should stop.  The traffic lane is in reference to a parking lot of some size and not an actual public road of some sort.  Strictly speaking about backing up while in a privately owned parking lot in Texas.  Please shed some light as to why this is not your interpretation of the law.  Thank you.

Hi Mike- You dad has an interesting perspective, however I believe strongly that if you talk to insurance companies and to the police department, they will interpret it that the person backing the vehicle out is the one with more responsibility to make certain the path is clear while backing. Sorry I can't make it any more clear. Perhaps Texas law has some other view of it, but my interpretation is quite common to the industry.
