I have a couple of Q's. 1st when is overtime implemented? 2nd if we p/u loads out of town and bring them back to phoenix and only charge out customer a flat rate can we pay our drivers a percentage of that rate and not hours?

Overtime is implemented for hourly employees after 40 hours are worked in  a week. If you are in the trucking industry you may pay your drivers on percentage of the loads hauled. You have to state that is how you are paying when the employee is hired and you should do it always the same way.

Do not pay hourly part of the time and percentage part of the time. Before any work is done make sure that the employee knows how he will be paid and agrees to it. It should be in writing.
