Dear Sir,

I have purchased an irrigated land(approx 5 acres)from a person of my own village(UP),since he resides in Gujrat & been 65 years old he sold off his property to me & i have made full cheque payment to him, since he with his entire family is settled in Gujrat , he sold the property to me with his consent to me.

One of the reason of selling his land to me is the seller has family dispute with his two sons, both the sons have not taken care of his father after death of mother.

Now both the sons(age is 40 & 35) have filed a case against me that the registry which i have done should be cancelled.

Please advice on what grounds should i work againt the cased filed against me, I have paid all my money to him.

ANSWER: Dear Pramod Kumar Dubey

You have not stated weather the person had got the land as per inheritance or it is his self acquired property. If it is his inheritance and the sons are also co sharers, then you might have a problem as you get only the share of the father and not the sons. But that will not amount to cancellation of registration. Even though you have not stated what the reason for cancellation is, I feel their allegation might be fraud on your part. That you will have to defend. You have to state that the man at the time of reghistration was hale and healthy and he had signed the deed as per his free will no fraud was committed. I think you have a good case at hand. Anyway consult a good lawyer who is well versed in  civil law who will be able to help you better

Dear Sir,

The person from whom i have purchased land is inherited from his ancestors, he had sold the land to me in his proper health & with free will. He don't want to compromise with his two sons as they have made him suffered too much in his old days especially after his wife died.

His two sons had filed allegation on the basis fraud, kidnapping,non payment which is totally baseless & wrong which i can easily prove as the seller was in a healthy state of mind plus i have done entire payment through cheque.the seller has maintained good property worth around crores in gujrat

Please suggest what should be done, as i am in fear of loosing the land as i done complete payment and i don't want it to share with his two sons. since no one from the  seller side stays in village(UP) so he sold it to me but his son can take shares in his builded property of gujrat.

since his son has framed a baseless allegation of fruad siting non-payment, kidnapping & some words which cannot be used for a social person, i am willing to file a case of DEFAMATION against them, please advice.

I do not think the allegations that the sons have tried to bring against you will hold. As you have all the records with you concerning the entire transaction, then I not do see any problem coming your way. Anyway as a precautionary measure, I would suggest that you consult a good lawyer in your locality. He will be able to help you better.
