I was in bed bath and beyond and a heavy big box fell on my head. According to Bed Bath and Beyond, that box did not belong there and a customer put it there, and that another customer caused it to fell on my head. They called me up to say that since its not their fault they dont cover anything. The scene has been recorded from their CCTV. From the whole thing i suffer from cuncusion
Do i have a case? What kind of settlement should i be looking for?
ANSWER: Hi Costas, this entire matter as to whether or not you have a case depends upon one thing and that is the amount of time between the "phantom" customer putting the heavy box in the wrong place and the time of your accident. If that box was placed in the dangerous position and they had ample time to have noticed it and taken it down then they are doubly negligent in not doing so. If the box had been placed there only a minute or less before it hit you and they would obviously never put the box up there then it was the customer who caused the injury. As far as any settlement goes it would depend upon the injury and how serious it is. At the very least they should offer to pay for your medical treatment.

i saw the same box being there for at least 10 minutes as i was in that section 10 minutes earlier than the incident. I saw the box moving, ready to fall, on a woman but she was next to it and grabbed it before it fell. As for my injuries, i suffer from mild concussion but i dont think its only that. My neck hurts and since it happen(last friday) i have been having headaches all day, i cant stand the bright light among with other things. As for their excuse that the "phantom customer" did that. Theres only one clearance section in bed bath and beyond and that box was in the clearance section with the clearance tag on.. Besides, who takes a 6 feet long box(maybe 10-15pounds or more) and carries it around just like that?
