6.5 Years Old Dbt With Chase Master Card

hello my  situation is the   following..       my original  CHASE mastercard balance on my account   was   like  950.00   but  I was   out  of the country  when  I made the whithdrawal    then  I  try  to pay  the balance ...  but   there was  really   difficult  to sent  the money  from other country..    they  sent  me  letters  and  letters   after   a long  time..   they   sent me  a letter   saying   that the   account   had been  settle..   by   a goverment fund  or put in a fidecomisse  or something   like that..     but   now   a   collection agency ..      BONDED COLLECTION  CORPORATION      sent  me  a letter  last  month    arguing  that    they had  purchased   my   credit  card debit from   chase manhattan bank usa national asocciation for    1550.00  is  this  correct after six  years and  half     and    what  THEY can do  against  me.    and   can  they   try to collect from  something  that I  may  own outside   the   US..    like  a  car   or  bank account  or even a house      since  I lost   the   settlement  letter...       what  options    do   I  have...    I was   living  in   CA   when  I sign   the   contract ...     I   call  chase mastercard   to   find  about it ...  but   they   just   gave me   a  telephone  number to  call...     I   will really   apreciatte   your   advice...     thank you

ANSWER: There is a statute of limitations on debt collection in all states. It looks like you are already past the SOL of 4 years unless they have a judgment already. It is not likely they paid that much for the debt although they may calculate interest to arrive at that figure. They likely paid 5-10 cents on the dollar. This means they may be willing to accept substantially less as a settlement in full if you have the resources to pay it. If you are past the SOL send them a letter advising them of the statute and advise them to cease all collection activity or you will file a complaint with the FTC.

If they have a judgment already this could extend the SOL and they could attempt to collect if you move back to the states. At this point you should not have much to worry about.

its me again..  thank you for your answer   but  I still have a doubt    how can I know  if  the already have  a  judgement on  me ..   and     the  ''SOL ''    does it  follow the  california laws    or    DELAWARE  LAWS since    I SIGN THE   CONTRACT IN CALIFORNIA ..  BUT I SENT THE APPLICATION  TO  OTHER  STATE...        SO  THEY  CAN'T   collect  outside the united sates... legally ...    thank for your  advice

The SOL applies under California law. It is the state where you lived and originated this account. Potentially, they can attempt to collect outside the US but it is not likely. First, it is an expensive process for the creditor since they need an attorney here in the US and one in the country you live. Second,it is difficult to find out if they can collect even if they get a judgment. and third of course is the SOL issue.

You may try to contact the courts in the county you lived in CA to see if they obtained a judgment or you can pull your credit reports to see if there are any public records listed.

You can obtained your credit reports free by going to www.annualcreditreport.com. This is the official web site for all three credit reporting agencies.
